Terms of Service
These Terms govern use of Eliminator Fantasy Sports websites, mobile applications, accounts, memberships, private leagues, and contests. By creating an account or using EFS, you agree to these Terms and any product-specific rules displayed and accepted for the experience you enter.
1. Operator and contact
The service is operated by Eliminator Fantasy Sports Inc., 32 Ashburnham Road, Toronto, Ontario M6H 2K3, Canada (EFS, we, or us). Questions, complaints, and appeals may be sent to survive@eliminatorfs.com.
2. Eligibility and accounts
You must be at least 18 years old, use one account in your own legal identity, provide accurate information, and use EFS only where it is offered and lawful. A product may impose additional eligibility, location, or verification requirements in its rules.
Keep your credentials secure. You are responsible for activity conducted through your account unless you promptly report unauthorized use. Accounts and contest entries are personal and may not be sold, transferred, shared, or used for another person.
3. EFS services and memberships
EFS offers fantasy-sports experiences including private leagues and the free-entry Eliminator Open. EFS does not charge a separate platform fee for an Open entry.
Optional Free, Silver, Gold, and Platinum membership levels may affect access and the number of Open entries available. A paid membership is a one-time, NFL-season-scoped purchase; it does not automatically renew. The price, currency, included benefits, and any applicable purchase terms are displayed before checkout.
4. Contests and rules
Each contest is governed by the Official Rules and incorporated materials displayed and accepted at entry. For the Eliminator Open, use the 2026 Official Rules, Gameplay Rules, and Scoring page.
If these Terms conflict with contest-specific Official Rules, the Official Rules control for that contest to the extent permitted by law. Private-league settings may configure features that do not apply to the Open.
5. Acceptable use
You may not:
- use bots, scripts, macros, automated entry, or automated lineup submission;
- create or control an account for another person or use multiple accounts to evade a limit;
- collude, share credentials, falsify identity or location, or exploit a technical error;
- obtain or use material non-public information or interfere with another user or EFS system;
- copy, scrape, reverse engineer, or commercially reuse EFS content or software except where applicable law permits; or
- use EFS in a way that violates law, these Terms, or applicable contest rules.
Research and lineup-recommendation tools are permitted when they do not directly enter, edit, or submit a lineup.
6. Enforcement and appeals
EFS may investigate suspected misconduct and may suspend an account, entry, standing, benefit, or payment while an investigation is pending. Consequences are applied under the applicable rules and law. A Contest decision may be appealed under the procedure and deadline in its Official Rules.
Self-exclusion takes effect immediately as described on the Responsible Play page and in applicable Contest rules.
7. Service operation
Live scores, ranks, availability, and other in-progress displays may be provisional. EFS may pause an affected operation when fraud, technical failure, provider failure, force majeure, or another event materially impairs service integrity. Contest cancellation, resumption, early termination, and prize treatment follow the applicable Official Rules.
EFS may update non-contest service features. We will not silently change a locked scoring-table version or alter a material contest rule merely for convenience.
8. Intellectual property
EFS and its licensors own the service, software, designs, trademarks, and original content. These Terms grant you a limited, revocable, non-transferable right to use the service for its intended personal purpose. They do not transfer ownership.
9. Privacy and communications
The Privacy Policy explains how EFS processes personal information. Transactional, integrity, rules, security, and service notices may be necessary to administer your account or a contest. Marketing communications are subject to the choices described in the Privacy Policy and do not override self-exclusion.
10. Third-party services
EFS relies on third parties for functions such as app distribution, authentication, hosting, location verification, sports data, analytics, communications, payment, and prize fulfillment. Apple, Google, the NFL, its clubs, and the NFL Players Association do not sponsor or administer the Eliminator Open.
11. Disclaimers and liability
EFS provides the service on an as-available basis. To the fullest extent permitted by law, EFS does not guarantee uninterrupted availability or that every device, connection, or third-party service will operate without error.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limits a nonwaivable consumer right. Contest-specific releases and limitations apply only as stated in the accepted Official Rules and to the extent permitted by law.
12. Disputes and governing law
Before filing a claim, send a written notice to survive@eliminatorfs.com describing the claim and requested resolution and allow 30 calendar days for informal resolution.
Subject to nonwaivable rights and remedies under the law of your jurisdiction, these Terms are governed by Ontario law and applicable federal Canadian law. Courts located in Toronto, Ontario have venue. These Terms do not require mandatory arbitration.
13. Changes
The version displayed and accepted for a contest remains part of that contest's record. Material changes are identified by an updated effective date and, when required, notice or renewed acceptance. A later version does not silently change a locked contest week.
